INCOME THAT MAY AFFECT BENEFIT PAYMENTS

Along with earnings, most other payments that workers receive based on their current or past employment may also affect benefit payments. You are automatically asked questions about these kinds of payments when you first apply for benefits and every week you make a request for benefit payment. Each time you request a benefit payment, you will be asked if you received or applied for these kinds of payments. You are required to answer the questions. The following list includes some of the most common types of payments that can affect unemployment benefits. The name of the payment is less important than how, why, or from whom the payment is made.

This income includes but is not limited to:

  • severance, notice, or retention pay, and any other payments made because of separation from employment;
  • sick pay and holiday pay;
  • vacation pay;
  • pension or 401K payments;
  • Social Security retirement or disability benefits;
  • workers’ compensation or other insurance for loss of wages;
  • back pay.

If benefit payments are affected by any income, you will be sent a written determination explaining the effect.

The following types of income will NOT affect benefit payments:

  • supplemental Social Security income (SSI) and survivor’s or dependent Social Security benefits;
  • investment income (including personal IRAs);
  • rental income from property you own, unless such rental is your primary occupation;
  • spousal or child support payments paid to you.
