Appeal hearing

Minnesota Law provides an opportunity for a fair and impartial hearing to any party who believes a determination is incorrect. The Appeal Hearing Guide explains how the appeal hearing process works.

Here's a summary:

  1. If you believe a determination is incorrect, you have the right to file an appeal. When you file an appeal, you are asking for a hearing to be scheduled with an Unemployment Law Judge.

    There are 3 ways to file an appeal: online, by mail, or by fax.

    Appeals must be filed by the deadline listed on the determination you are appealing. An appeal submitted online or by fax is not considered filed until it is actually received.

  2. Once we have received your request for an appeal, a date and time will be scheduled for your appeal hearing. Appeal hearings are done by telephone . Under unusual circumstances a case will be heard in person.
  3. You will be mailed an Appeal Hearing Guide and a notice of the hearing. This information will give you more details about the appeal hearing process.
  4. If the determination involves another party, such as your former employer/employee, that party will also be notified of the date and time of the appeal hearing and may participate.
  5. It is important for you to participate in the appeal hearing. If you must request a different date or time for the hearing, notify us as soon as possible. If you do not participate, the Unemployment Law Judge may dismiss the appeal.
  6. After the appeal hearing, the judge will issue a written decision, either agreeing with, or changing the original determination. In most cases, the judge will mail a written decision within 20 days of the hearing.
  7. If you receive the judge's decision and you want the judge to review the decision, you can Request a Reconsideration of the decision.

You are required to notify the UI Program of any change in mailing address or phone information using the Self-Service System. Updates can be completed online at www.uimn.org or by calling the automated phone system and a menu will direct you to staff to change your contact information. It is extremely important to keep this information up-to-date.
